Get Seen is a sports discovery platform designed to help athletes showcase themselves and their athletic achievements.

The Platform may allow athletes and their parents or guardians to:

• create athlete profiles;
• provide athletic information such as sport, position, team, graduation year, measurements, achievements and other relevant information;
• upload or link photographs, videos and highlight footage;
• create shareable athlete profiles or cards;
• share profiles through social media, email, messaging and other platforms;
• appear in searches and discovery tools;
• participate in tournament, team, event or organization pages; and
• access additional free or paid features that Get Seen may introduce.

Get Seen may also provide tools allowing coaches, scouts, teams, tournament organizers and other sports-related users to discover and view athletes.

Get Seen is a discovery and profile platform. We are not an agent, recruiter, coach, scout, school, team, league or sports governing body.

Get Seen may be used to create profiles for athletes under the age of 18.

If an athlete is under the age required to independently provide valid consent under applicable law, the athlete’s account or profile must be created, authorized or managed by a parent or legal guardian.

By creating or managing a profile for a minor, you represent and warrant that:

• you are the minor’s parent or legal guardian or otherwise have the legal authority necessary to create and manage the profile;
• you consent to the collection, use and disclosure of the minor’s information as described in our Privacy Policy;
• you authorize the publication and display of the information, photographs and videos you choose to make available through the Platform; and
• you have the authority to grant the rights relating to content described in these Terms.

Get Seen may request additional information or verification of parental or guardian authority.

We may restrict, suspend or remove a minor’s profile if we cannot reasonably verify appropriate authorization.

Parents and guardians are responsible for deciding what information about their child is appropriate to make publicly available.

We strongly recommend that users do not publish sensitive information such as:

• home addresses;
• personal phone numbers of minors;
• school schedules;
• real-time locations;
• travel itineraries;
• government identification numbers;
• medical information; or
• other information that could create an unnecessary privacy or safety risk.

Get Seen may remove information that we believe presents a privacy or safety concern.

You agree to provide accurate and current information when creating an account or profile.

You are responsible for:

• maintaining the confidentiality of your login credentials;
• activity occurring through your account;
• ensuring that profile information remains accurate;
• controlling who has access to your account; and
• notifying Get Seen if you believe your account has been compromised.

You may not impersonate another person or create an athlete profile without appropriate authorization.

Athlete profiles may contain information supplied by athletes, parents, guardians or other authorized users.

Depending on the features selected, profiles may be publicly accessible and may be viewed by people who do not have a Get Seen account.

You understand that information made public on the Internet can potentially be copied, downloaded, captured, shared or redistributed by others outside Get Seen’s control.

You are responsible for determining which information you choose to publish.

“User Content” includes information, photographs, videos, highlight clips, graphics, statistics, biographies, achievements, links and other material submitted to the Platform.

You retain ownership of your User Content.

By submitting User Content to Get Seen, you grant Get Seen a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, display, format, transmit and distribute that content as reasonably necessary to operate, improve and promote the Platform and provide the services you request.

This licence does not transfer ownership of your content to Get Seen.

Where Get Seen wishes to use an identifiable minor’s photograph or video in advertising or promotional campaigns outside the ordinary operation of that athlete’s profile or the Platform, Get Seen may seek separate consent where required or appropriate.

You may remove User Content or request deletion of your account subject to our Privacy Policy and any legal or operational retention requirements.

You may only upload or submit content that you own or have permission to use.

By uploading content, you represent that:

• you have the necessary rights and permissions;
• the content does not infringe copyright, privacy, publicity or other rights;
• any required permission from the athlete, parent, guardian, photographer, videographer, team, league, tournament or other rights holder has been obtained; and
• Get Seen’s permitted use of the content will not violate the rights of another person or organization.

Do not upload copyrighted game footage, broadcasts, music or other material unless you have the right to use it.

Get Seen may remove content in response to a valid rights complaint.

The purpose of Get Seen is to help athletes get seen.

Accordingly, information designated as public may be:

• displayed on public athlete profiles;
• searchable through Get Seen;
• viewed by coaches, scouts, teams, organizations and other users;
• included on tournament or event pages;
• accessible through a shared link; and
• shared by the athlete or profile manager outside Get Seen.

Certain privacy and visibility controls may be provided depending on the account type and Platform features.

Get Seen does not guarantee who will or will not view a public profile.

Get Seen may allow coaches, scouts, recruiters, teams, leagues, tournaments and other sports organizations to access athlete information.

Unless Get Seen expressly states otherwise, Get Seen does not independently verify or endorse every person who identifies themselves as a coach, scout, recruiter or representative of an organization.

Users should exercise appropriate caution when communicating with people they meet through the Platform.

Minors should not arrange private meetings or provide private contact information to an unknown adult without the involvement and permission of a parent or guardian.

Get Seen may introduce identity or organizational verification features, but verification does not constitute an endorsement or guarantee.

Athletic statistics, measurements, rankings, achievements, team information and other performance information may be supplied by users or obtained from permitted third-party sources.

Unless specifically identified as verified by Get Seen, Get Seen does not guarantee the accuracy of athlete information.

Users may not knowingly falsify:

• statistics;
• age or birth year;
• team affiliation;
• achievements;
• awards;
• rankings;
• measurements;
• game footage; or
• other material information.

We may remove or correct information we reasonably believe is fraudulent or misleading.

Get Seen provides visibility and discovery tools.

We do not guarantee that using Get Seen will result in:

• recruitment;
• scouting;
• team selection;
• tournament selection;
• scholarships;
• sponsorships;
• representation;
• employment;
• contracts;
• advancement to higher levels of competition; or
• contact from any particular coach, scout or organization.

Athletic decisions are made independently by third parties.

You may not use Get Seen to:

• harass, threaten, bully or exploit another person;
• contact minors for inappropriate purposes;
• impersonate another person;
• create unauthorized profiles;
• post knowingly false or fraudulent information;
• distribute malware or malicious code;
• scrape or harvest user information without authorization;
• attempt to bypass Platform security;
• interfere with the operation of Get Seen;
• use automated systems to access the Platform without permission;
• sell or misuse athlete information;
• infringe intellectual property rights;
• engage in illegal activity; or
• use the Platform in a way that creates a safety risk for a minor.

We may investigate suspected violations and suspend or terminate accounts.

The safety of young athletes is important to Get Seen.

Users may report profiles, messages, content or conduct they believe violates these Terms or creates a safety concern.

Get Seen may remove content, restrict communication, suspend accounts, preserve relevant information or take other reasonable measures in response to safety concerns.

Where appropriate or legally required, Get Seen may cooperate with law enforcement or child protection authorities.

Get Seen may offer free and paid memberships, subscriptions or premium features.

Pricing, features and billing frequency will be disclosed before purchase.

Unless otherwise stated at the time of purchase, subscriptions may automatically renew until cancelled.

Users will be informed of applicable charges before completing a purchase.

Get Seen may change subscription pricing or features upon appropriate notice and in accordance with applicable law.

Additional subscription terms may apply when paid services are introduced.

Users may cancel paid subscriptions using the cancellation methods made available through the Platform.

Cancellation generally prevents future renewal charges but does not necessarily provide a refund for an existing subscription period unless required by law or expressly provided by Get Seen.

Deleting an athlete profile does not necessarily automatically cancel a separately billed subscription. Users should follow the applicable cancellation process.

Get Seen may integrate with or link to third-party services, including video hosting providers, payment processors, social media platforms, analytics providers and tournament or sports organizations.

Those third parties may have their own terms and privacy practices.

Get Seen is not responsible for third-party services that it does not control.

Get Seen may partner with tournaments, leagues, teams, camps or other organizations.

A partnership, integration or tournament page does not mean that Get Seen controls the organization or is responsible for its decisions.

Likewise, unless specifically stated, a tournament’s use of Get Seen does not mean that every athlete appearing on Get Seen is officially registered with or endorsed by that tournament.

The Get Seen name, logos, designs, software, interfaces, graphics, technology and other Get Seen-created materials are owned by or licensed to Get Seen and are protected by applicable intellectual property laws.

Except as expressly permitted, users may not copy, modify, reproduce, distribute, sell or commercially exploit Get Seen’s proprietary materials without written permission.

If you provide suggestions, ideas or feedback regarding Get Seen, you authorize us to use that feedback to develop and improve the Platform without compensation or obligation to you.

Get Seen reserves the right to review, restrict, remove or disable access to User Content or accounts that we reasonably believe:

• violate these Terms;
• violate applicable law;
• infringe another person’s rights;
• create a safety or privacy risk;
• contain fraudulent information; or
• may harm Get Seen, its users or the integrity of the Platform.

We are not obligated to monitor every profile or piece of content.

We may suspend or terminate access to Get Seen for violations of these Terms or where reasonably necessary to protect users, Get Seen or third parties.

Users may stop using Get Seen at any time and may request account deletion as described in our Privacy Policy.

Certain provisions of these Terms that by their nature should survive termination will continue to apply.

Your use of Get Seen is also governed by our Privacy Policy.

The Privacy Policy explains how we collect, use, disclose, retain and protect personal information, including information relating to young athletes.

Where consent is required, Get Seen will seek to obtain consent in accordance with applicable Canadian privacy laws.

We work to keep Get Seen available and functioning properly, but we cannot guarantee uninterrupted or error-free operation.

Features may occasionally be unavailable due to maintenance, technical problems, third-party services or circumstances outside our control.

We may modify, add or discontinue Platform features.

To the extent permitted by applicable law, Get Seen and the Platform are provided on an “as is” and “as available” basis.

Get Seen does not warrant that:

• the Platform will always be available;
• all User Content will be accurate;
• every user is who they claim to be;
• athletes will receive exposure or opportunities;
• coaches or scouts will view a particular profile; or
• use of the Platform will produce a particular athletic or professional outcome.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

To the maximum extent permitted by applicable law, Get Seen and its directors, officers, employees, contractors and affiliates will not be liable for indirect, incidental, special, consequential or punitive damages arising from use of the Platform.

Get Seen is not responsible for decisions made by coaches, scouts, teams, leagues, tournaments or other third parties based on information appearing on the Platform.

Nothing in these Terms limits liability that cannot legally be limited under applicable law.

To the extent permitted by law, you agree to indemnify and hold Get Seen harmless from claims, liabilities, damages or reasonable costs resulting from:

• content you submit;
• your violation of these Terms;
• your infringement of another person’s rights; or
• your misuse of the Platform.

This provision does not apply to the extent prohibited by applicable consumer protection law.

Get Seen may update these Terms as the Platform evolves.

When material changes are made, we may provide notice through the Platform, by email or by another appropriate method.

Where required by law, we will obtain additional consent before applying material changes.

The “Last Updated” date will identify the most recent version.

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.

Subject to applicable consumer protection laws, disputes relating to these Terms or the Platform will be resolved in the courts of Ontario, Canada.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

These Terms, together with the Privacy Policy and any additional terms applicable to specific Get Seen services, constitute the agreement between you and Get Seen concerning your use of the Platform.
